Major Blow to Our Fight
I am not sure how we are going to fight this but the FDA has classified kratom as a new drug and not a dietary supplement. This is from Susan Ash: We were dealt a really heavy blow and a harsh dose of reality today during a call with the American Herbal Products Association (they are on our side) who put into perspective what the FDA has done (past tense thanks to Gotleib’s press release and other maneuvers). Kratom is now considered a new drug and NOT a dietary supplement. Because of this, the NDI - new dietary ingredient - route isn’t really an option (NDIs would only cover a specific ingredient, not the whole plant). The only way forward is as an investigational new drug (IND) or an NDI for a specific ingredient, not the whole plant, and no one has the kind of money or time to invest in an IND. So the DEA has announced plans to review the FDA’s now-complete 8-factor in order to schedule it.
We're going to fight this like we fought the DEA last year, with the power of the people appealing to their legislators in Congress. We will fight in the media -- we're already hearing from a pharmacologist who is planning a series of articles to appear in Forbes magazine. We'll be doing a Twitter campaign in the coming week.
There are further weapons we have to stop any scheduling, which Susan is quite aware of. She is trying to cause a panic and there is no need for it. We have work to do. Contact your Senators and Congressional representatives -- Let them hear your stories, what kratom has done for you.
The American Kratom Association has a page devoted to the things WE can do to stop any ban or scheduling of kratom. This fight is just beginning.
It's rather humorous that the FDA recently approved OxyContin for 11-year-olds... but they think kratom is too dangerous for adults! They have once again played their hand as a tool of the pharmaceutical industry. Read up on the career of Dr. Gottlieb, the newly appointed FDA Commissioner. Think he has any conflicts of interest?
So, they have declared war on another herb. Are we going to let them win? I promise you the American Kratom Association is planning to win this fight.

When you see fb post and youtube videos about what Susan said, you can't help go into panic mode. I have read from another kratom forum, take what Susan Ash stated with a grain of salt. On the FB page were Susan posted this, she was asked to provide specifics but she could not. This was from another forum:
This "interpretation" of Gottlieb's statements was discussed on a private conference call between several dues-paying AHPA members of which Susan Ash is not one of those dues-paying members. This information is not fact, it is supposition derived from an interpretation, hearsay. She was asked numerous times for proof which, of course, she had none because it was a private conference call. She was asked how she attained this information considering that she is not a dues-paying member of AHPA, which she simply dodged, which was easy because the thread was blowing up around her.
If indeed there was an AHPA conference call. I suggested that we (AKA) become members of AHPA when Susan was still with us, so we did. I'm wondering why AKA wasn't invited to any conference call on the kratom topic.
Without much proof to back it up, this sounds like excited hearsay from a highly emotional lady.
There is likely some grain of truth in this tale of woe, but how we choose to take the news is up to us.

Tobacco/nicotine is a stimulate and alcohol is a depressant. Both are legal drugs.
If Kratom is classified as a drug, which it should not, does is necessarily mean it will be banned.
My mom is a smoker,61 years and she knows there is zero benefit from nicotine except the next cigarette will stop the withdrawal from her last cigarette. Also smoking is known to cause fatal diseases and has no beneficial uses.
This thanksgiving my family represents people from the politically right to the left they all support the legality of Kratom and are appalled at what the FDA is trying to do.The only scheduling or compromise I would possibly settle for is under the ATF. It sounds like Cannabis will be regulated under the ATF if the 3 currents bills succeed in nation wide legalization. I don't want a cherry picked alkaloid or a pill, I want the leaf unadulterated other than from the grinding process.

Unfortunately they cannot go the ATF route. We do not produce Kratom in the US so it would not be a candidate under those regulations.
Not yet haha.... I'm not familiar with those regs, although a lot of tobacco is not grow here and most or at least half of all alcohol is imported. How does that factor in?
For the people saying FDA this and FDA that, they have input and recomendations but they cannot actually do anything unless the drug is being sold for human consumption. If it is clearly labeled research only not for human consumption, it's no longer under the FDA, it is how research chemicals get away with being sold online.
The FDA is only a regulatory agency meaning they have nothing to do with the laws directly. They can fine and shut down kratom vendors who market it as a cure or treatment or who sell it for human consumption. The only people who really can do anything is the DEA (the enforcement agency) and Congress.
The DEA can emergency schedule drugs to schedule one status but even that only last for 12 months and there is a criteria that must be met, two of witch is if it cannot have medical value, and that it must be seen as a imediate public health crisis.
But really, the only people who can do anything is congress and the Senate witch is run by republicans who think global warming is a chinese hoax and that the earth is only 6000 years old. My hopes arnt high, but I still have emailed my senator and congress reps as should all of you.
Their have been some disurbing comments made mostly by republicans in congress (and our drug czar appointed by trump who thinks legal weed has made the opioid epidemic worse and the head of the DOJ, Jeff sessions who says no one who smokes weed is a good person) such as; kratom is making the opioid crisis worse and that it is really deadly. Out of 435 memebers of congress, only 50 stood up to the dea last time. If you really want to save kratom vote the republicans out in the mid-terms. Democrats listen to science more than republicans and most think science lies or is fake.
I hate to make this political, but it really is now a political issue now.
Also I'm not saying don't write the heads of the FDA as that is important, don't forget to write the people who really make the magic happen.
